RentMine.com is a venue site that allows registered users to inventory and rent their personal possessions, property, vehicles, and services to rent from other participating users on the site (the “Site” or “Service). The Site is owned and operated by JB Lang, Inc., doing business as RentMine.com (“Company”). This Agreement (the “Agreement”) is between you and Company whether or not you create an account on the Site.

By completing the registration process and clicking on the “Create Your Account” button, you will become a registered user and agree to be bound by the terms and conditions (“Terms”) of this Agreement. If you do not agree to the Terms please do not use the Site or register for the Service. The Terms are subject to change, effective upon posting such on the Site. At our sole discretion we may send such changes to account holders via e-mail or regular mail. Continued use of the Site or Service following the posting of any changes in this Agreement will indicate acceptance by you of such changes.

1. Eligibility: By creating an account on the Site, you represent and warrant that (a) you are 17 years of age or older; (b) all registration information that you submit is truthful and accurate and you will maintain the accuracy of such information; (c) your use of the Site or Service does not violate any applicable law or regulation. RentMine.com and JB Lang, Inc. reserves the right to determine whether an individual is eligible for the Service. Use of the Service is void where prohibited.

2. Using the Site: The Service provides registered users the ability to create an inventory of their items, property, goods, services and/or vehicles and to rent them and the opportunity to rent other individual's items, services and/or vehicles.  RentMine does not verify a user’s inventory, is not involved in the rental transaction, is not the agent of either the owner or the renter, does not have authority over either and, therefore, is not responsible for any claims, demands or damages that arise from any disputes between lenders and borrowers. To achieve a good rating and continue as a registered user of the Service, users are required to comply with the RentMine Service’s Terms of Agreement, the RentMine Ethos, and any contract they agree to with other users of the RentMine Service. You may not post content or items in an inappropriate category or areas on the Site; violate any laws, third party rights, or our policies such as the Prohibited and Restricted Items policies, use the site if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from our site; fail to deliver payment for items rented by you, unless the owner has materially changed the item's description after you bid, a clear typographical error is made, or you cannot authenticate the seller's identity; fail to deliver or make available items rented or lended from you, unless the buyer fails to meet the posted terms, or you cannot authenticate the buyer's identity; manipulate the price of any item or interfere with other user's listings; circumvent or manipulate our fee structure, the billing process, or fees owed to RentMine; post false, inaccurate, misleading, defamatory, or libelous content; take any action that may undermine the feedback or ratings systems; transfer your RentMine account (including feedback) and User ID to another party without our consent; distribute or post spam, chain letters, or pyramid schemes; distribute viruses or any other technologies that may harm RentMine, or the interests or property of RentMine users; copy, modify, or distribute content from the Sites and RentMine's copyrights and trademarks; or harvest or otherwise collect information about users, including email addresses, without their consent.

3. Account Password and Security: As part of the registration process, you must select a password for access to your account. You shall be responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You may be held liable for losses incurred by RentMine or a third party due to use of your password or account by someone else.

4. Abuse of the Service:   RentMine and the RentMine community work together to keep RentMine.com working properly and safe. Please report problems, offensive content, and policy violations to us. Without limiting other remedies, we may limit, suspend, or terminate our service and user accounts, prohibit access to our website, delay or remove hosted content, and take technical and legal steps to keep users off the Sites if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for a long time.

5. Privacy Policy and Security: Our Privacy Policy is part of this Agreement.

6. Disclaimers: RentMine.com and JB Lang, Inc., its members, agents, employees, partners, and consultants disclaim any and all responsibility and liability for the conduct, whether online or offline, of any user of the Site. RentMine.com and JB Lang, Inc. is not involved in the actual rental transaction and has no control over and does not guarantee the ability of a user to rent, lend or borrow or that a user will rent, lend or borrow as promised.

RentMine.com and JB Lang, Inc. disclaims any and all responsibility and liability for the accuracy, quality, content, timeliness, completeness, legality, reliability, operability or availability of the information, software, products, or services or other materials contained on or available through the Site, or that defects or errors will be corrected, or that the content is free of other harmful components.

The RentMine.com site and service, and all such information, software, products, services, and materials are provided “as is” and, “as available.” To the fullest extent permitted by applicable law, RentMine.com and JB Lang, Inc. expressly disclaims all warranties with regard to this information, software, products, services, and materials including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. No advice or information, whether written or oral, from us will create any warranty not expressly stated herein. Some states do not allow the exclusion or limitation warranties, so the above disclaimers and exclusions may not apply to you.

You hereby acknowledge that use of the site is at your own risk.

7. Limitation of Liability: In no event shall RentMine.com or JB Lang, Inc. be liable to you for any direct, indirect, incidental, punitive, special, or consequential damages arising out of or in any way connected with your use or misuse of and reliance on the site or service, or delay or inability to use the service, or for any information, products or services obtained through the service, whether based on contract, tort, strict liability or otherwise, even if RentMine.com or JB Lang, Inc. has been advised of the possibility of damages. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

Notwithstanding the foregoing and to the fullest extent permissible under applicable law, RentMine.com’s and JB Lang, Inc.’s aggregate liability to you in any circumstance is limited to $100.00.

8. Fees and Services:  Joining Rentmine and renting and item from an owner or an owner's agent involves no fees from RentMine.com. There is also no fee for listing an item.  We do charge commission fees for owner's or owner's agents who successfully rent their items, vehicles, property, or services to another individual on the RentMine.com venue. When you list an item or use a service that has a fee you have an opportunity to review and accept the fees that you will be charged based on our Fees schedule, which we may change from time to time. Changes to that Policy are effective after we provide you with at least fourteen days' notice by posting the changes on the Sites. We may choose to temporarily change the fees for our services for promotional events (for example, free rental days) or new services, and such changes are effective when we post the temporary promotional event or new service on the Sites.

Unless otherwise stated, all fees are quoted in U.S. Dollars. You are responsible for paying all fees and applicable taxes associated with the Sites in a timely manner with a valid payment method. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms. (This includes charging other payment methods on file with us, retaining collection agencies and legal counsel.)

9. Release by You: By registering as a user of the Service, you agree to release and hold harmless RentMine.com and JB Lang, Inc., its members, officers, agents and employees from any and all claims, demands, damages (actual and consequential) of every kind and nature, known or unknown arising from or in any way connected with your inventory, lending, borrowing, service, or renting transactions.

10. No Agency: You agree that no agency, partnership, joint venture, employee-employer or franchisee-franshisor relationship is intended or created by this Agreement. Paragraph headings are inserted only as a matter of convenience and reference, and such headings are not intended and shall not be construed to define, limit, establish, interpret, or describe the scope, intent or effect of any provision of this Agreement.

11. Copyright Policy: We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act. If you believe that your work has been copied and posted on the Site in a way that constitutes copyright infringement, please provide RentMine.com with the following information: (1) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (2) a description of the copyrighted work that you claim has been infringed; (3) a description of where the material that you claim is infringing is located on the Site; (4) your address, telephone number, and e-mail address; (5) if possible, information to permit us to notify the user who posted the allegedly infringing material; (6) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (7) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner ’s behalf.
